To access certain features, you may need to register for an account ("Account" or "Sub Account"). You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your password and for all activities that occur under your Account. You agree to notify us immediately of any unauthorized use of your Account.
We offer various service packages (e.g., "Startup Package," "Growth Package," "Premium Package") with specific features, pricing, and minimum commitment periods as detailed on our Site or in your service agreement.
You agree to pay all fees associated with your chosen Services package as described on our Site or in your service agreement. Fees are typically billed monthly in advance.
You authorize us (or our third-party payment processor) to charge your chosen payment method for all applicable fees.
Due to the nature of our services (strategy, setup, and ongoing execution), fees paid for services rendered or for committed periods are generally non-refundable. We invest significant time and resources into each client project from the outset.
For qualifying clients on specific long-term engagements (as explicitly stated, e.g., typically 12-month commitments), if you do not see measurable results directly attributable to our Services within 12 months of continuous engagement, we commit to providing an additional 2 months of dedicated revamping and growth services completely free of charge, as outlined in the "12-Month Results Guarantee" section on our Site.
We reserve the right to suspend or terminate access to Services for accounts with overdue payments.
The Site, Services, and all related content, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, our proprietary tools (e.g., Maven Strategy Assistant, Workflow Assistant), templates, and the "Launch Maven" name and branding are the exclusive property of Launch Maven Agency or its licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use our tools and resources as part of your active service subscription.
Any pre-existing materials, data, or content you provide to us for use in connection with the Services ("Client Content") remains your property. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display Client Content solely for the purpose of providing the Services to you.
For clients, subject to full payment of all applicable fees, tangible deliverables created specifically for you as part of the Services (e.g., a completed website design, specific funnel builds within your GoHighLevel account) will become your property. However, Launch Maven retains ownership of its underlying methods, know-how, generic templates, and proprietary tools used to create such deliverables.
Freelancers retain ownership of their pre-existing skills, portfolios, and general know-how. Work product created by a freelancer for a specific client project will be subject to the agreement between the freelancer and the client.
You agree not to use the Site or Services to:
Clients are responsible for providing timely feedback, necessary access (e.g., to existing accounts), and accurate information required for us to perform the Services effectively.
Our Services integrate with or utilize third-party platforms, notably GoHighLevel and AI services (Gemini, Deepseek, Claude). Your use of such third-party services is subject to their respective terms and privacy policies. We are not responsible for the operation or policies of third-party services.
The Site may contain links to third-party websites. We are not responsible for the content, accuracy, or opinions expressed in such websites, and such websites are not investigated, monitored, or checked for accuracy or completeness by us.
EXCEPT FOR THE "12-MONTH RESULTS GUARANTEE" AS SPECIFICALLY OUTLINED HEREIN AND ON OUR SITE, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We explicitly state that "SUCCESS TAKES TIME (90+ DAYS)." Overnight success is a myth. Real growth takes consistent effort and proper systems. We do not promise instant results. Our approach involves testing, refining, and optimizing over a period, typically a minimum of 90 days, to gain traction.
While we strive to achieve the best possible outcomes, we do not guarantee any specific level of business growth, lead generation, sales, or other performance metrics, except as may be covered by the "12-Month Results Guarantee." Business success depends on various factors beyond our direct control, including market conditions, your product/service, and your own efforts.
While we strive for accuracy, our tools (including AI-powered assistants and calculators) are provided for guidance and informational purposes. We do not guarantee the accuracy or completeness of information provided by these tools, and you should independently verify any critical information.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LAUNCH MAVEN AGENCY, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO US FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO SUCH CLAIM.
You agree to defend, indemnify, and hold harmless Launch Maven Agency, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, any use of the Site's content, services, and products other than as expressly authorized in these Terms or your use of any information obtained from the Site.
These Terms become effective upon your first use of the Site or Services and remain in effect until terminated.
You may terminate your account and these Terms by ceasing to use the Services and providing us with written notice, subject to any minimum commitment periods specified in your service package. Early termination may incur fees for the remainder of the committed term.
We may suspend or terminate your access to all or any part of the Services at any time, with or without cause, with or without notice, effective immediately. Grounds for termination may include (i) a breach of these Terms, (ii) non-payment of fees, (iii) requests by law enforcement or other government agencies.
Upon termination, your right to use the Services will immediately cease. If your Account or access is terminated, we may, in our sole discretion, delete your Account and any information associated with it. Provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the Philippines, without regard to its conflict of law principles.
Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in Makati City, Philippines, using the English language in accordance with the Arbitration Rules of the Philippine Dispute Resolution Center, Inc. (PDRCI) then in effect, by one commercial arbitrator with substantial experience in resolving intellectual property and commercial contract disputes.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms.
These Terms, together with our Privacy Policy and any specific service agreement you enter into with us, constitute the entire agreement between you and Launch Maven Agency concerning the Services.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.
Our failure to enforce any part of these Terms shall not constitute a waiver of our right to later enforce that or any other part of these Terms.
